(New York) – The Thai authorities should immediately investigate the murder of a prominent poet and “Red Shirt” political activist widely known for his opposition to Thailand’s law banning criticism of the monarchy, Human Rights Watch said today.
On April 23, 2014, at about 2 p.m., an unidentified gunman fired five times at Kamol Duangphasuk, 45, who was in his car at a restaurant parking lot in Bangkok’s Lad Phrao district. The gunman escaped on a getaway motorcycle. Kamol was struck twice in the chest and later died in the hospital.
“The brutal and outrageous killing of poet and Red Shirt activist Kamol can only worsen the already tense political situation in Thailand,” said Brad Adams, Asia director. “The Thai authorities need to quickly investigate this murder and bring whoever is responsible to justice – wherever that investigation leads.”
Kamol, known by his penname “Mai Nueng Kor Kunthee,” was widely recognized for his poetry since the late 1980s. He strongly opposed the 2006 military coup and the subsequent crackdown on critics of the monarchy. Kamol took part in many rallies of the United Front for Democracy against Dictatorship (UDD), known as the “Red Shirts,” and he called himself a “Red Shirts poet.” After the government’s violent crackdown on the UDD in 2010, he helped organize a gathering outside the Bangkok criminal court every Sunday to talk about the plight of those prosecuted on lese majeste (criticism of the monarchy) charges and push for amnesty for political prisoners.
Kamol’s murder is the latest violent attack on activists and academics known to be critical of the monarchy and the lese majeste law.
On February 12, 2014, assailants fired repeated shots and threw homemade bombs at the home and car of Somsak Jeamteerasakul, a history professor at Thammasat University who is an outspoken critic of the monarchy. Somsak was at home but was not harmed in the attack.
Two years ago, on February 29, 2012, law professor Worachet Pakeerut, who had called for an amendment to Thailand’s lese majeste law, was assaulted by two men outside Thammasat University’s law school. The assailants punched Worachet several times in the face and broke his eyeglasses.
Ultra-royalist groups, and many military commanders, senior government officials, and politicians from all sides, consider critical comments against the lese majeste law and any call to amend or revoke the law as disloyal to the monarchy. Article 112 of the penal code states that “Whoever defames, insults or threatens the king, queen, the heir-apparent or the regent, shall be punished with imprisonment of three to fifteen years.” People charged with lese majeste offenses are routinely denied bail and often remain in prison for many months awaiting trial. In most cases, convictions result in harsh sentences. The recently formed pro-monarchy Garbage Collection Organization publicly referred to those accused of committing lese majeste offenses as “garbage” and vowed to “exterminate” all of them, saying freedom of expression and academic freedom do not justify negative comments about the monarchy.
Human Rights Watch has long raised concerns about the devastating impact on freedom of expression caused by the enforcement of lese majeste laws, and the ease with which the lese majeste law has been used for political purposes by the authorities.
Thailand’s King Bhumibol Adulyadej has publicly stated that he is not above criticism. In his 2005 birthday speech he said, “Actually, I must also be criticized. I am not afraid if the criticism concerns what I do wrong, because then I know. Because if you say the King cannot be criticized, it means that the King is not human. If the King can do no wrong, it is akin to looking down upon him because the King is not being treated as a human being. But the King can do wrong.”
“Kamol’s murder heightens the climate of fear felt by those who speak out against Thailand’s draconian lese majeste law,” Adams said. “The Thai authorities need to find Kamol’s killer, and also urgently move to amend the law prohibiting criticism of the monarchy, and permit an environment in which all topics are open to discussion.”

Both sides in Thailand’s political crisis must back down from a “showdown in May” that many fear will turn violent and inflict deep damage on the country’s economy and reputation, the main opposition party leader has urged.
Abhisit Vejjajiva, head of the Democrats and a former prime minister, called for talks and the start of political reforms ahead of elections within months, warning that the Arab Spring had shown the dangerous potential for countries to suddenly erupt in violence.
His comments come amid growing fears among business people and others of the impact of a crisis that has paralysed the government of Yingluck Shinawatra, prime minister, for almost five months and is undermining Thailand’s ambitions to take a central role in southeast Asia’s economic integration.
“[People] see the country moving ahead next month into what could be even more confrontation, more threat of violence,” Mr Abhisit said in an interview. “Given the accumulated frustration and suffering and loss of opportunity for the country, I think it’s really time people begin to speak up for the middle ground.”
Mr Abhisit rejected criticism that he had played a big part in the current turmoil by boycotting an election in February and throwing his weight behind six months of street protests. He insisted instead that he had been trying to bring the two sides together for “months” to talk about a reform package covering areas such as corruption, decentralisation and education.
While he said warnings from some government supporters and others of civil war should Ms Yingluck be ousted by two, soon-to-be-concluded, legal cases were partly “rhetoric”, he acknowledged there were “genuine risks” of serious trouble in the latest phase of a struggle that has already claimed more than 20 lives. Kamol Duangphasuk, a pro-government activist and poet who had criticised the country’s strict lèse-majesté laws, was shot dead on Wednesday by unidentified gunmen in a restaurant car park in north Bangkok.
“It’s not very difficult to whip up sentiment against the other side,” Mr Abhisit said. “Even the Arab Spring began from some minor incidents. It just gathers momentum – and if people are in the mood for conflict, who knows what it will lead to.”
Ms Yingluck’s government has slashed economic growth forecasts and put more than $15bn of investment decisions on hold since the start of the crisis, during which the prime minister has headed a caretaker administration shorn of many revenue-raising and decision making powers. Thailand’s central bank warned this week that growth would slow down more than expected during the first half of this year, because of the impact of the political situation on investment and the country’s important tourism industry.
Private sector business groups warned this week that Thailand urgently needed a new government to approve projects and prepare for next year’s planned launch of a single economic community of the 10-member Asean group of southeast Asian countries.

ขณะที่การประชุมของชุดทำคดีทางตำรวจยังไม่สรุปสาเหตุว่ามาจากเรื่อง ใด แต่ตั้งไว้ทุกประเด็น ทั้งการเมือง เรื่องส่วนตัว และการขึ้นเวทีอาจจะกล่าวพาดพิงใคร ทางตำรวจได้ไล่ดูเทปการขึ้นพูดบนเวทีทุกชุด โดยเจ้าหน้าที่ได้เชิญ น.ส.สุดา มาสอบปากคำ รวมถึงประเด็นการจัดรายการวิทยุคู่กัน เพื่อใช้เป็นแนวทางในการหาเบาะแสลอบสังหารในครั้งนี้ น.ส.สุดา เป็นคนที่ใกล้ชิดนายกมล คนหนึ่ง อ้างว่า ตอนนี้สถานการณ์การเมืองมีแต่ความใช้ความรุนแรง ไล่ล่า สังหารบรรดาแกนนำ ซึ่งหนึ่งในนั้นก็คือคุณไม้หนึ่งที่ฝ่ายตรงข้ามมีความต้องการจะกำจัดผู้นำ ประชาธิปไตย

• การเมืองพ่วง “กองทุนกำจัดขยะ”
พ.ต.ต.เสงี่ยม สำราญรัตน์ ประธานที่ปรึกษาสำนักงานเลขาธิการนายกรัฐมนตรี และยังเป็นนักจัดรายการสถานีโทรทัศน์ดีเอ็นเอ็นด้วยกันกับ น.ส.สุดา และนายกมล กล่าวว่า ความขัดแย้งการเมืองครั้งนี้มีเดิมพันสูง เพราะฝ่ายแกนนำ กปปส. มีคดีกบฏ คดีฆ่าคนเสื้อแดง 91 ศพ ถอยไม่ได้จึงได้เกิด “แผนเด็ดแกนนำ” ซึ่งตนรู้แผนนี้มา 2 เดือนแล้วว่ามีเจ้าหน้าที่ไปดูแลม็อบ และแบ่งชุดทางยุทธศาสตร์ใช้แผนมวลชนน้อยเหลือเพียงกองกำลังรับจ้าง และคนมีสีบางคนรับจ้างเป็นการ์ด ซึ่งผู้ตายไม่ระวังตัวเพราะไม่มีศัตรูกับใคร
“สาเหตุมาจากการเมืองแน่นอน คนร้ายมีการสะกดรอยเฝ้าดูว่าขึ้นรถคันไหน หน้าตาเป็นอย่างไร สำหรับผู้ตายจัดรายการเชิงประวัติศาสตร์การเมืองลึกไปเรื่องความมั่นคง แต่ไม่ได้ระบุตัวบุคคลแนวการพูดก็ไม่ก้าวร้าวเป็นกวีศิลปิน พูดตรงลึกเชิงเปรียบเปรย มาตรการป้องกันดูแลความปลอดภัยของคนเสื้อแดงหลังจากแกนนำถูกยิงก็อยู่ที่ ประธาน นปช. จะแถลงการณ์อะไรออกไป ส่วนตัวแล้วคนเสื้อแดงไม่มีความปลอดภัยไม่มีคนดูแล ต้องดูแลตัวเอง เพราะหวังจะใช้หลักกฎหมายเป็นที่พึ่งพิงก็ไม่สามารถช่วยได้ ส่วน “กองทุนกำจัดขยะ” นั้นมีจริง ไม่งั้นคงไม่ประกาศออกมาโดยอ้างว่าผู้อื่นไม่รักสถาบันจึงต้องออกมาเก็บมา จัดการล่าฝ่ายตรงข้าม
• จี้แกนนำเสื้อแดง ระวังตัว
ขณะที่ นายก่อแก้ว พิกุลทอง แกนนำ นปช. กล่าวว่า เรื่องนี้ตนมองว่าสาเหตุอาจจะมาจากเรื่องทางการเมือง เพราะ 1. ก่อนหน้านี้มีข่าวว่ามีการตั้งทีมไล่ล่าแกนนำเสื้อแดง ตั้งแต่ก่อนนายขวัญชัย ไพรพนา ประธานชมรมคนรักอุดรฯ ถูกยิง จนนายขวัญชัยถูกยิง แต่ข่าวนี้ก็ไม่มีใครยืนยันได้ 2. อาจจะเป็นคนที่มีอุดมการณ์ทางการเมืองตรงข้ามพอดี และเกิดอารมณ์ชั่ววูบ ซึ่งเป็นไปได้ทั้ง 2 แนวทาง และส่วนตัวไม้หนึ่ง เท่าที่ตนทราบ ก็ไม่เคยขัดแย้งกับใคร ทั้งนี้จากรูปรอยกระสุน มองว่าเป็นมืออาชีพ เพราะกระสุนเข้าเป็นกลุ่มและนิ่งมาก กระสุนไม่เคลื่อนไปไหน ซึ่งเป็นเรื่องของเจ้าหน้าที่ตำรวจที่ต้องสอบสวนต่อไป
“ผมขอเตือนไปยังแกนนำเสื้อแดงให้ระมัดระวังในการไปไหนมาไหนมากขึ้น แต่สิ่งที่น่าห่วงคือ สถานการณ์หลังจากนี้อาจจะรุนแรงมากขึ้น ถ้าเป็นแบบนี้ อนาคตจะเป็นอย่างไร เพราะต่างฝ่ายต่างมีพวกเยอะ ประเทศไทยคงมีปัญหาหนัก ผมจึงอยากให้ผู้ใหญ่ช่วยกันคลี่คลายสถานการณ์ เอาฟืนออกจากกองไฟ อย่าสุมเพิ่ม” นายก่อแก้วกล่าว
ขณะที่ นายธนาวุฒิ วิชัยดิษฐ โฆษก นปช. กล่าวว่า เราไม่ทราบประเด็นในการยิงในครั้งนี้ และต้องดูที่มาที่ไป ซึ่งเป็นเรื่องของเจ้าหน้าที่ตำรวจที่จะต้องตรวจสอบในเรื่องนี้ แต่ในช่วงหลังนายกมล ได้ไปจัดรายการกับ น.ส.สุดา และมีการร่วมกลุ่มปฏิญญาหน้าศาล หากสาเหตุมาจากเรื่องการเมือง ถือว่าโหดร้ายเป็นอย่างมากสำหรับประเทศไทย เพราะคนที่ถูกฆ่ามักจะเป็นผู้ที่เรียกร้องประชาธิปไตย
“สถานการณ์ ณ เวลานี้ เหมือนฝ่ายอำมาตย์ ก็ได้ตั้งองค์กรเก็บขยะแผ่นดิน ซึ่งไม่แน่ชัดว่าตั้งขึ้นมาเพื่อกวาดล้างคน ที่เหมือนกับไม่จงรักภักดี และไม่รู้ว่าองค์กรนี้จะฆ่าหรือกวาดล้าง เหมือนสมัยก่อน 6 ตุลา 19 หรือไม่ ที่เอานักศึกษามายิงจนต้องหนีเข้าป่า ซึ่งเรื่องนี้ต้องมีการเฝ้าระวังกันต่อไป เพราะประเด็นนี้ถือว่าเป็นประเด็นที่ละเอียดอ่อนมาก ต้องระวัง” นายธนาวุฒิ กล่าว และว่า เสื้อแดงไม่มีใครคิดทำร้ายหรือทำลายสถาบัน ส่วนนักวิชาการบางส่วนที่ออกมาวิพากษ์วิจารณ์ให้มีการปรับปรุงกฎหมาย แต่ปัจจุบันโซเชียลเน็ตเวิร์ก มีการตัดต่อได้ง่าย เพื่อที่จะใส่ร้าย
โฆษก นปช. กล่าวอีกว่า อย่างไรก็ตาม คนเสื้อแดงถึงแม้ไม่ชอบกัน ก็ไม่เคยคิดที่จะถือปืนมารบกัน เพราะถือว่าทุกคนเป็นคนไทยด้วยกัน ต้องให้ประชาชนเป็นผู้ตัดสิน จึงอยากให้มีการเฝ้าระวังทุกฝ่าย ไม่ว่าเสื้อเหลือง เสื้อแดง และยืนยันว่าพวกตนไม่เคยคิดจะจับปืนมาฆ่าใคร
ด้าน นายศิโรตน์ คล้ามไพบูลย์ นักวิชาการเสื้อแดง ได้โพสต์ข้อความลงในเฟซบุก Sirote Klampaiboon ว่า “ความน่ากลัวที่เศร้าที่สุดของเรื่องนี้คือไม้หนึ่ง อาจเป็นกวีคนแรกที่ถูกยิงตายกลางเมืองหลวงของประเทศไทย เพราะแม้กระทั่งจิตร ภูมิศักดิ์ หรือ ทวีป วรดิลก ก็ยังไม่ถูกยิงตายกลางเมืองแบบนี้ เราจะจดจำคุณในฐานะกวี”
• มโนไปเรื่อย! เริ่มเหมือนช่วงปี 2518-19
ด้าน เฟซบุ๊ก นายพิชิต ลิขิตกิจสมบูรณ์ นักวิชาการเสื้อแดง โพสต์ว่า บรรยากาศเริ่มเหมือนเมื่อช่วงปี 2518-19 ในช่วงปีนั้น จนถึง 6 ตุลา 19 นักวิชาการ ผู้นำนักศึกษา ผู้นำกรรมกร และผู้นำชาวนา ถูกยิงตายรวมกันกว่าร้อยศพ เป็นข่าวเกือบทุกสัปดาห์ ติดต่อกันเป็นเวลาปีกว่า ตายเหมือนใบไม้ร่วง โดยจับคนยิงไม่ได้เลยแม้แต่รายเดียว เป็นการลอบสังหารทางการเมือง คาดว่า เป็นหน่วยล่าสังหาร death squad ของทหารในยุคนั้นที่ไล่ฆ่าตามบัญชีรายชื่อที่เตรียมไว้รายที่สร้างความสั่น สะเทือนที่สุดคือ ดร.บุญสนอง บุญโยทยาน อาจารย์มหาวิทยาลัยธรรมศาสตร์ และนายอมเรศ ไชยสอาด นักศึกษามหาวิทยาลัยมหิดล และหนึ่งในแกนนำนักศึกษายุคนั้น
การไล่ล่าลอบสังหาร มาถึงจุดสูงสุดคือ การปิดล้อม ม.ธรรมศาสตร์ และฆ่าหมู่นักศึกษาในนั้นอย่างโหดเหี้ยมทารุณที่สุดเมื่อวันที่ 6 ตุลา 19 หลังจากนั้น ก็คือ “สงครามกลางเมือง” เมื่อนักศึกษาราวสามพันคนทั่วประเทศ หนีเข้าป่า จับปืนหันกลับมาสู้กับอำนาจรัฐโหดในเวลานั้น ไม่นึกว่า ในชีวิตนี้ จะต้องมาเผชิญกับบรรยากาศและเหตุการณ์แบบนี้อีก ได้กลิ่นอายอำมหิตและคาวเลือดโชยมาชัดเจน และที่เกิดซ้ำได้ ห่างกันตั้ง 40 ปี ก็เพราะ “รากเหง้า” ของปัญหาในวันนั้นเมื่อปี 18-19 มันยังอยู่มาถึงวันนี้นั่นเอง และก็หันมาใช้วิธีการเดิมอีกเมื่อประชาชนบังอาจลุกขึ้นท้าทายอำนาจของพวกเขา อีกครั้ง ถ้าฝ่ายเผด็จการเลือกหนทางและวิธีการกระทำต่อประชาชนอย่างนี้แล้ว การนองเลือครั้งใหญ่คงหลีกเลี่ยงไม่ได้แล้ว และก็จะไม่มีใครห้ามได้
• เพจแดงกุรายต่อไป “โด่ง อรรถชัย”
ขณะเดียวกัน ในแฟนเพจของคนเสื้อแดง เช่น เพจกูต้องได้ 10 ล้าน จากทักษิณแน่ๆ หรือเพจร่วมกันเชียร์ คุณยิ่งลักษณ์ เพื่อไทย ได้โพตส์ข้อความและรูปภาพสภาพศพนายกมล และรูปภาพนายทหารใหญ่คนหนึ่ง โดยอ้างว่า จากการสรุปข้อมูลเบื้องต้น ที่ทีมงานส่งมาให้ ทีมสังหารไม้หนึ่ง น่าจะเป็นฝีมือของนายทหารผู้นี้ เพราะงานก่อนหน้านี้ ก็ยิงนายขวัญชัย
